The New York City Department of Buildings recently announced that rodent abatement would be required during construction for certain types of work. Rodent abatement requirements were enacted by Local Law 109 of 2022, which amended the Administrative Code and Building Code.
A licensed exterminator must be hired to exterminate the site for rodents as per the Department of Health and Mental Hygiene requirements prior to the issuance of permits for the following types of construction:
- Construction work involving 50% or more of the area of a building
- Vertical or horizontal enlargements that increase the building by more than 25%
- Demolishing 50% or more of the area of a building
- Full building demolition
