What Property Owners Need to Know About Local Law 55

Enacted in April, Local Law 55 of 2024 (LL 55/24, 55-24) creates new requirements for electric vehicle charging stations, or Electric Vehicle Supply Equipment (EVSE). While prior regulations required parking areas to be capable of handling future installation of EV charging stations, LL 55/24 now requires installation of EV charging stations.

New open parking lots, parking areas in new buildings, and existing parking areas undergoing significant renovation must:

  • Include Level 2 charging stations for at least 20% of parking spaces; and
  • Ensure a minimum of 60% of parking spaces are capable of supporting EVSE.

 

One direct current fast charging station may be substituted for 10 Level 2 charging stations; however, this substitution cannot be used for more than 50% of required Level 2 charging stations.

For existing open parking lots with 10 or more spaces and existing parking garages with 10 or more spaces that are undergoing construction work, LL 55-24 requires retroactive measures that must be implemented by January 1, 2035:

  • Level 2 charging stations for at least 20% of parking spaces; and
  • At least 40% of parking spaces capable of supporting EVSE.

 

As with new parking garages, existing open lots and garages may substitute one direct current fast charging station for 10 Level 2 charging stations. This substitution cannot be used for more than 50% of required Level 2 charging stations.

Existing parking lots and existing parking garages that have no construction work are not subject to any retroactive requirements.
