City Council Clears the Way for Permanent Outdoor Dining Regulations

The New York City Council voted to approve new regulations for permanent outdoor dining. This includes revisions to the pre-pandemic sidewalk dining, known as sidewalk cafes, for 12 months a year in all boroughs. Roadway dining is now allowable from April through November, expanding on the emergency pandemic outdoor restaurants program. Roadway dining structures must be removed during the winter months.

The NYC Department of Transportation (DOT) will continue to be responsible for administering the licensing and revocable consents for sidewalk cafes and roadway cafes. The implementation details of the program have not yet been released by DOT. Restaurants with existing outdoor dining will need to apply under the new program.
